My Canberra Handyman is a small business. Depending on the circumstances, the small-business exemption in the Privacy Act 1988 (Cth) may apply.

Whether or not that exemption applies to a particular activity, this policy explains how I collect, use, disclose, store and protect personal information. Where the Privacy Act applies, I will comply with its applicable requirements.

  • technical website information, including IP address, browser and device information, pages visited, referral information, cookies and analytics data.

I do not normally require sensitive information. Please do not provide health information, identity documents, financial records or other sensitive information unless it is reasonably necessary and has been specifically requested.

3. How information is collected

Personal information may be collected:

  • through the website enquiry form
  • by telephone, email, SMS or other electronic communication
  • through social media messages
  • during a site visit or while carrying out work
  • through quotes, invoices and payment records
  • from an owner, occupant, tenant, property manager, real estate agent, family member, business representative or another person authorised to arrange the work
  • automatically through website cookies, anti-spam tools, security systems and analytics services.

If you provide another person’s personal information, you should only do so where you have their authority or where it is reasonably necessary to arrange or carry out the requested work.

You should let that person know their information may be handled in accordance with this policy.

4. Why personal information is collected and used

Personal information may be collected, held and used to:

  • assess an enquiry and determine whether I can assist
  • prepare or revise a quote or estimate
  • confirm the identity, authority or connection of a person arranging work
  • help prevent fraud, unauthorised access or work being arranged without appropriate approval

  • meet legal, regulatory, insurance and safety requirements
  • maintain the security and operation of the website and business systems
  • understand general website use and improve services.

If required information is not provided, I may be unable to assess the enquiry, verify authority to arrange the work, provide a quote or proceed with the service.

5. Disclosure of personal information

Access to personal information is limited to authorised persons and service providers who reasonably require it for legitimate business purposes.

Where reasonably necessary, personal information may be disclosed to:

  • website, communications, information-technology, cloud-storage and business administration providers
  • banks, payment providers, accountants, bookkeepers, lawyers, insurers, debt-recovery providers and other professional advisers
  • suppliers, manufacturers or service providers where assistance is required to assess work, identify materials or source a replacement part

  • government agencies, regulators, courts, tribunals, insurers or law-enforcement bodies where required or authorised by law
  • a prospective purchaser or professional adviser if the business or its assets are sold or transferred, subject to appropriate confidentiality arrangements.

I do not sell or rent customer personal information.

6. Cloud services and overseas processing

I use third-party technology and cloud services to operate the business, including services used for website hosting, communications, customer administration, accounting, document storage, security and backups.

Some providers may store, process or support information outside Australia, including in the United States and other countries in which their infrastructure or service providers operate.

I take reasonable steps to select and manage service providers appropriately. Information processed overseas may also be subject to the laws of the country in which it is processed.

7. Photographs, videos and documents

Photographs, videos and documents supplied by you or obtained in connection with the work may be used to:

  • assess the work and prepare a quote
  • identify materials, fittings or replacement parts
  • record existing conditions
  • document progress and completion
  • maintain safety, warranty, insurance and dispute records.

Please avoid including people, vehicle registrations, mail, financial information, security details or other unrelated personal information in photographs or documents.

Images may be used for internal business records and training.

Images may also be used for promotional purposes where they do not reasonably identify a person, private address or sensitive property information. Identifying photographs or videos will not be published for marketing without appropriate permission.

8. Identity and authority verification

To help protect customers, occupants and properties, I may request reasonable evidence of a person’s identity, authority or connection with the service address before accepting or proceeding with work.

The type and level of verification requested will depend on the circumstances, the nature of the work and the information already available.

Please do not send identity documents, financial records or other sensitive documents unless they have been specifically requested.

Where a document is requested, only the minimum information reasonably required should be provided. Unrelated information should be redacted before the document is supplied.

Verification information will only be used for identity, authority, fraud-prevention, service-delivery and related record-keeping purposes.

Verification information will not be retained longer than reasonably necessary unless retention is required for a dispute, insurance matter, legal obligation or other legitimate business purpose.

9. Website analytics and cookies

The website may use cookies, analytics, anti-spam and security tools.

These tools may collect technical information such as your IP address, approximate location, browser or device type, referral source, pages visited and the date and time of your visit.

This information is used to maintain website security, prevent misuse, understand general website use and improve website performance.

This information does not ordinarily provide me with your name or direct contact details unless you separately submit those details through an enquiry or communication.

You can control or block cookies through your browser settings. Some website functions may not operate correctly if cookies or JavaScript are disabled.

10. Marketing communications

I do not routinely add customer or enquiry details to marketing mailing lists.

Your contact details may be used for communications reasonably connected with your enquiry, quote, booking, work, invoice, payment, complaint or service history.

If promotional email or SMS marketing is introduced in the future, it will be sent in accordance with applicable marketing and spam laws and will include a way to opt out.

11. Security

I take reasonable administrative, technical and physical steps appropriate to the nature and volume of the information held to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Access to personal information is restricted to authorised persons and service providers with a legitimate need for access.

No website, email, internet transmission or electronic storage system can be guaranteed to be completely secure.

If a suspected data breach occurs, I will investigate it, take reasonable steps to contain and address it, and notify affected people or relevant authorities where required by law.

12. Retention and deletion

Personal information is retained only for as long as reasonably required for the purposes for which it was collected.

This may include providing services, maintaining business and transaction records, meeting taxation or legal obligations, managing warranties, insurance matters, complaints, disputes and unpaid accounts.

Different types of information may be retained for different periods depending on the purpose for which the information is held and any applicable legal requirements.

When personal information is no longer reasonably required, I will take reasonable steps to securely destroy or de-identify it, subject to applicable legal requirements and reasonable technical limitations.

13. Access and correction

You may ask to access personal information I hold about you or request that inaccurate, out-of-date, incomplete, irrelevant or misleading information be corrected.

Requests can be submitted through the My Canberra Handyman contact form. Please write “Privacy request” at the beginning of your message.

I may need to verify your identity before providing access or making a correction.

I will respond within a reasonable period and will generally aim to respond within 30 days.

Access may be limited where providing it would unreasonably affect another person’s privacy, disclose legally privileged or confidential information, or where access may otherwise lawfully be refused.

14. Privacy complaints

If you have a concern about how your personal information has been handled, please submit it through the My Canberra Handyman contact form and write “Privacy complaint” at the beginning of your message.

I will aim to acknowledge the complaint within five business days and provide a response within 30 days, although more complex matters may take longer.

Where the Privacy Act 1988 (Cth) applies, you may also be able to lodge a complaint with the Office of the Australian Information Commissioner.

You may wish to obtain independent legal advice about other available rights or remedies.

15. Third-party websites

The website may contain links to websites or services operated by other organisations.

I am not responsible for the content, security or privacy practices of those third-party websites. You should review their privacy policies before providing personal information.

16. Changes to this policy

This policy may be updated when business practices, technology or legal requirements change.

The current version and its last-updated date will be published on the My Canberra Handyman website.
